Wacky Jacky’s Retreats Terms and Conditions

Deed of Acknowledgment

The Participant makes the following representations to the Organiser:

Acknowledgement

• I acknowledge that participating in the Wacky Jacky’s Bali Retreats  conducted by the Organiser whether it be at Candidasa, Bali Indonesia or in Australia (Retreat) may involve risk of harm to myself.  I agree that I enter into the Retreat at my own risk.  I am aware that persons are only able to participate in the Retreat on the distinct understanding that they do so at their own risk.

• I acknowledge that I am physically and medically fit for participation in the Retreat.  Limited Mobility – Guests must be able to climb stairs, get on/off coach, bus or car without assistance.  There is walking involved in these retreats.  If you have particular mobility requirements please notify us in advance so we can investigate other arrangements and may incur further charges.

• I understand that it is a condition of participation in the Retreat that I execute this Deed.  I sign this Deed of my own free will having read and understood its items.

• I acknowledge that Wacky Jacky’s has a vested interest in their retreats and agree not to copy in any form – any of the activities, ideas, itineraries, wording of their retreats whether being offered prior, present or in the future.

• I acknowledge that I have read and ticked the “T&C” on the website (in registration Process) regarding the “Cancellation Fees” and that Wacky Jacky;s  reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately. Please check the latest information posted herein to inform yourself of any changes.

Release of Liability

• I acknowledge that the Organiser will employ third parties to provide goods and services for the Retreat.  I acknowledge that no representations of any nature have been made by the Organiser in relation to the suitability or quality of the Third parties employed.

• I covenant that I will not bring about any claim or action whatsoever against the Organiser in relation to any negligent act or omission of any third party employed by the Organiser.

• I acknowledge and agree that the definition of “third party” in Clause 4 and 5 refers to, but not limited to: taxi drivers and other private and public transport operations of any nature, airline carriers of any nature (including airport and airline staff), hotel operators and their employees and any other operator providing accommodation of any nature, merchants of goods and services, food vendors, caterers and distributors, chefs and any persons involved with the preparation of food, porters, stevedores and tradesmen of any nature, government officers of any nature and rank, customs officials and any other third party employed by the Organiser.

Activities Outside the Scope of Itinerary

I acknowledge that any act that I participate in, which is not included in the itinerary, is undertaken at my own risk and no claim or action of any nature can be made against the Organiser in relation to such an act.

Insurance

• I acknowledge that the Organiser has strongly recommended that I obtain comprehensive travel insurance on booking your retreat.

• I further acknowledge and understand that the Organiser will not provide this insurance nor has made any representation to this effect.

Release of Liability

• To the extent permitted by law, I agree that I am liable for (and indemnify the Organiser in respect of) any:-

  • Property damage: or

  • Personal injury or death to participants in the Retreat; or

  • Personal injury or death to myself; that is caused by me and/or the Organiser and/or any party associated or employed by the Organiser or as a consequence of my presence at, or participation in, the Retreat.

• To the extent permitted by law, I will abide by all directions given to me by the Organiser, its employees, agents or contractors during the retreat.

• To the extent permitted by law, I release and discharge from all liability (of any kind) each of the following persons:

  • The Organiser; and

  • Office holders of the Organiser; and

  • Instructors of the Organiser; and

  • Members of the Organiser; and

  • Servants and agents of the Organiser; and

  • Any third party that is participating in the Retreat.

Reliance of Third Parties

I agree that this document may be used by any person released in accordance with paragraph 4, 5, 6 and 12 as a bar to proceedings commenced by me in relation to injuries sustained in the course of my presence at, or participation in, the Retreat.

Limitation on Recovery

I acknowledge and agree that in the event that the Organiser is deemed liable for any loss or damage sustained by me whilst on Retreat, the scope of the Organisers liability will be limited to the cost of the Retreat as charged by the Organiser.

Consent for Use of Materials

I acknowledge that the Organisers and its employees and agents may take photographs and make video recordings of me whilst on Retreat (Materials) and use these Materials in their promotional activities on mediums including but not limited to Facebook and the Organiser’s Website.
